Terms of Service
These Terms of Service ("Terms") govern your access to and use of the VoiceSoft platform, website at voicesoft.io, tools, and associated services (the "Service"), operated by VoiceSoft ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Service Nature and Entertainment Purpose
VoiceSoft provides experimental, cloud-based audio processing, transcription, and generative speech features. The Service is provided primarily for creative, demonstration, educational, and personal entertainment purposes on an "as is" and "as available" basis.
The Service is not intended, certified, or designed for mission-critical, legal, medical, emergency, evidentiary, or high-risk business operations. Outputs generated by artificial intelligence may contain inaccuracies or artifacts; you agree not to rely on any outputs without independent verification.
2. Eligibility and Accounts
You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to create an account or use the Service. You are solely responsible for maintaining the security of your credentials and for all activities conducted through your account.
3. User Content and Voice Rights
You retain ownership of any media, audio files, text, and materials you upload or submit to the Service ("User Content"). You grant VoiceSoft a worldwide, non-exclusive, royalty-free license to host, transmit, and process your User Content solely to provide and operate the requested platform features.
Voice Permissions: You represent and warrant that you hold all necessary rights, legal authority, and explicit permissions from any individual whose voice, likeness, or personal data is submitted for transcription, translation, or voice synthesis. You agree not to use the Service to generate non-consensual voice clones, deceptive synthetic media, defamatory content, or impersonate third parties without proper authorization.
4. Acceptable Use
You agree not to misuse the Service or assist others in doing so. Specifically, you agree not to: (a) probe, disrupt, or overload platform infrastructure; (b) reverse engineer, decompile, or extract the architecture of underlying models; (c) bypass access limits, authentication, or rate controls; or (d) generate abusive, fraudulent, or unlawful materials.
5. Storage and File Backups
The Service is an experimental environment and does not provide permanent archival storage or guaranteed data preservation. Uploads, projects, and generated outputs may be cleared, reset, or become unavailable during routine technical maintenance or platform updates. You are responsible for keeping independent local backups of all important files.
6. Assignment and Corporate Successors
VoiceSoft reserves the right to assign, transfer, or novate these Terms, associated operating rights, and platform assets to any affiliate, partner, or successor entity in connection with any corporate restructuring, incorporation, or asset transition, without requiring additional individual consent.
7. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, OR NON-INFRINGEMENT.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VOICESOFT, ITS OPERATORS, CONTRIBUTORS, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, SYSTEM DOWNTIME, OR BUSINESS INTERRUPTION ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE SHALL BE LIMITED TO THE GREATER OF FIFTY UNITED STATES DOLLARS (US $50.00) OR THE TOTAL FEES PAID BY YOU TO VOICESOFT IN THE PAST SIX MONTHS.
9. Indemnification
You agree to defend, indemnify, and hold harmless VoiceSoft and its operators from any third-party claims, liabilities, damages, and legal costs arising from your User Content, your violation of these Terms, or your unauthorized use of another person's voice or intellectual property.
10. Dispute Resolution
These Terms are governed by general commercial principles and the laws of the State of Delaware, United States, without regard to conflicts of law provisions. Any dispute arising under these Terms shall be resolved on an individual basis, and you waive any right to initiate or participate in a class action or representative proceeding.
